Terms of Service

1. Who we are

The AES Trades course ("the Course") and the AES TradingView indicators ("the Indicators") are provided by AES Trades Ltd, a company registered in England and Wales, company number 17526968, registered office 71 Caxton Street, Barnsley, S70 2LF ("we", "us"). Contact: ashton@aestrades.com. By buying or using the Course or the Indicators you agree to these terms.

2. Who can buy

You must be at least 18 and able to enter a binding contract. You must not buy if you are in a country or on a list subject to UK, EU or US sanctions.

3. What you get

The Course is digital educational content about trading index futures, delivered through Whop. It includes the AES Trading Model, educational videos and access to the premium chat, as described on the product page. Access starts as soon as your payment is confirmed and lasts for the lifetime of the Course.

4. Your licence

We give you a personal, non-exclusive, non-transferable licence to use the Course for your own learning. You must not:

  • share your login or let anyone else use your access
  • copy, record, download, resell, publish or redistribute any part of the Course
  • use the Course to create a competing course or product

We may end your access without a refund if you break this section.

5. Premium chat

Be respectful. Do not post spam, promotions, other people's personal information or anything unlawful. We may remove messages or end chat access for anyone who breaks these rules. Messages in the chat are not financial advice.

6. Indicators

The Indicators are chart tools for TradingView, sold through Whop. To use them you need your own TradingView account. After purchase you give us your TradingView username and we grant your account access to the invite-only scripts. Access is personal to that username and lasts for as long as the product page states.

  • You must not share, resell, copy, decompile or republish the Indicators or their code.
  • We may update, change or improve the Indicators at any time.
  • TradingView is a third-party service. We are not responsible if TradingView changes its platform, rules or availability in a way that affects the Indicators.
  • We may remove access if you break these terms, or if a payment is refunded or reversed.

The Indicators display information based on price. They do not tell you when to buy or sell, they do not predict the market, and they can show levels or signals that turn out to be wrong.

7. Education only

The Course and the Indicators are for educational purposes only. They are not financial, investment, tax or trading advice, and they are not a recommendation to buy or sell any financial instrument. We do not provide trade signals, manage money or act for you. You make your own trading decisions and are responsible for them.

8. Not a regulated adviser

AES Trades Ltd is not authorised or regulated by the UK Financial Conduct Authority, and is not registered with the US Commodity Futures Trading Commission (CFTC), the National Futures Association (NFA) or the US Securities and Exchange Commission (SEC) as a commodity trading advisor, investment adviser or broker. We publish general educational material that is not tailored to any individual.

9. Results, testimonials and simulated trading

Any results, screenshots, payouts or testimonials we share are individual experiences, are not typical and are not a promise of what you will achieve. Most people who trade futures lose money. Prop firm evaluation and funded accounts are often simulated accounts, and results in them are hypothetical.

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.

If we ever link to a broker, platform or prop firm and earn a commission, we will say so clearly.

10. Risk

Trading futures carries substantial risk of loss and is not suitable for everyone. Any examples, charts or results shown are for illustration. Past performance does not indicate future results. We make no promise that you will make money or pass any prop firm evaluation.

11. Third parties

Payments and access are handled by Whop, and Whop's own terms also apply. The Course may mention brokers, platforms or prop firms. We are not responsible for them, their rules or their decisions about your accounts.

12. Payment and price

The price is shown at checkout and charged by Whop. We may change prices for future buyers. A change never affects a purchase you have already made.

13. Changes to the Course

We may update, add to or reorganise the Course content to keep it accurate and useful.

14. Refunds

All sales are final once you have accessed the Course or been given access to the Indicators. See our Refund Policy for full details and your rights if the Course is faulty.

15. No warranty

TO THE FULLEST EXTENT ALLOWED BY LAW, THE COURSE AND THE INDICATORS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR UNINTERRUPTED SERVICE. This does not affect rights you have as a consumer that cannot be excluded, including your rights under the UK Consumer Rights Act 2015.

16. Our liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY TRADING LOSSES, LOST PROFITS, PROP FIRM FEES OR ACCOUNT LOSSES, OR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS, WHETHER OR NOT YOU USED THE COURSE OR THE INDICATORS. OUR TOTAL LIABILITY TO YOU FOR ANYTHING ELSE IS LIMITED TO THE AMOUNT YOU PAID US. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law. Some US states do not allow certain exclusions, so some of these may not apply to you.

17. Your responsibility

You agree to cover any claims, losses or costs we suffer because you broke these terms, shared our content or misused the Indicators, to the extent the law allows.

18. Changes to these terms

We may update these terms. The version in force when you bought applies to that purchase.

19. Disputes and where you live

If something goes wrong, please email us first and we will try to fix it within 14 days. These terms are governed by the law of England and Wales, and disputes will be handled by the courts of England and Wales. If you are a consumer living elsewhere, including in the United States, you keep any protections that the law where you live says cannot be removed, and you may be able to bring a claim in your local courts.

20. Copyright

All course material, videos, documents and indicator code belong to AES Trades Ltd and are protected by copyright. To report someone sharing our content, or if you believe something we published infringes your rights, email the contact address above with the details.
